Officials confirmed Tuesday that the district's plans to build five new energy-efficient schools and the merger are being investigated by state law enforcement.

The results of the state's investigation will be sent to SK's Attorney General's Office.
District officials issued a statement Tuesday in response to Freedom of Information Act (FOIA) requests and requests. The county initially declined a request for some email records, but agreed to release them after receiving a letter from media attorney Jay Bender.

SLED spokesman Tom Perry said he could not provide any details on the matter. But in recent months, SLED agents have interviewed several district officials, including board members, about the case. These interviews focused on how the contract to build the new school was awarded.
The district provided SLED with emails related to a request for proposals for first-floor energy-positive schools built after winning a $220 million contract in 2015.

District reports indicated that the SLED has been investigating the case since December 2015. It was released to all local media after the media contacted district officials to say they had obtained documents supporting an independent investigation.

The emails provided to SLED by the district were between First Floor CEO Robby Ferris and former Horry County School Board attorney Keith Powell. The notices were written before the district issued a request for proposals outlining needs for the new schools.

The correspondence between the lawyer and the builder dates back to June 2014. The emails show Ferris and Powell discussing the RFP, including whether or not to use a contractor, to justify the project without a bidding process long before the county issued the RFP. for new schools.
In an email, Powell told Ferris that while the Harry County School District was not aware of his communication at the time, he could provide a "snapshot of procurement options" for the schools.

Powell wrote, "I found that the administration knew nothing of this request for proposal." "Who is this proposal for? I like the dbom (design-build-operate-maintain) model, it may work here, but being an existing customer of HCS, we now see a gap in it and we need to Need to know what's going on."
In response, Ferris wrote, "I think you've outlined the course we need now. Regarding your question; the head of facilities (Matt Dean) doesn't want to start it if he doesn't think that it's viable. He doesn't want people to get excited about an opportunity that won't work. So we're hoping you can help us find a direction so we can submit a 'concrete proposal' and the Superintendent Can work out the details after asking Matt to accept the offer.

In another email, Ferris wrote to Powell: "The second question is whether you would consider using an AIA (American Institute of Architects) design contract between my firm and the school district, or would you prefer some other type of contract? "

In another email dated June 16, 2014, regarding the financing, Ferris wrote to Powell, "It would be great if we could say they are buying buildings, not construction services." The district's request for proposals for the schools ultimately asked for "design and construction services" for five "high-performing, high-energy schools".

"All I saw was an aggressive salesperson," said school board member Holly Hennford. "It's Robbie getting an offer from someone who represents us, who's going to look out for our interests, and he's allowed to influence the stakes."
"I think the ethics board should slap him (Powell) on the hand," Hunniford said. "I think he should know that he has to represent his clients and their best interests. They should slap his wrist [and tell him] not to do that again."

When contacted, Ferris said that his correspondence with Powell was solely regarding the terms of the industry contained in the RFP.
"Matt Dean, the District Director of Construction Management, indicated that he would like us to speak directly with Mr. Powell about this. At the time, I understood that Mr. Powell was developing an RFP and that he would like to hear from us on industry regulations. Help and guidance was needed," Ferris said in a statement, adding that he never interviewed anyone on his SLED team.

In 2012, the school board paid Cardnow Tech $875,000 for a district-wide evaluation that showed a need for four new schools before the project was put out to bid. Ferris's firm submitted a conceptual design plan but was not the final bidder for the four planned schools.

That didn't stop him from having a conversation with then-facilities executive director Matt Dean and Powell in the summer of 2014, when emails revealed he laid out his idea for energy positive schools, meaning they use more energy than they use. produce more energy. At that time the selection of eligible bidders for four schools in the district had started.

In those 2014 emails, Ferris offered to proceed without a bid to implement his single-vendor idea into energy-positive schools and to ensure that his company got the job, but the schools submitted anyway. Did.
On October 3, 2014, Ferris met with then-school board president Joe Defeo, former Burroughs & Chapin CEO Doug Wendell, school board members Neil James, and Henniford at James' office in Santee Cooper.
